Please read these Terms of Service ("Terms") carefully before using the Kwitly mobile application ("Service") operated by NilPointer Software ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Kwitly is a receipt tracking and expense management application that allows users to:

• Scan and digitize receipts using AI-powered OCR technology
• Store receipt data locally
• Track and analyze spending patterns
• Export financial data
• Access premium features through paid subscriptions

3. User Accounts

Kwitly uses anonymous authentication. No email address or personal identifiers are required to use the app. However, you are responsible for maintaining the security of your device and any data stored within the app.

4. Subscriptions and Payments

4.1 Free Tier

The free version of Kwitly provides limited AI scanning capabilities and basic features. Specific limitations are displayed within the app.

4.2 Premium Subscription

Premium subscriptions unlock additional features including unlimited AI scanning, advanced analytics, and cloud backup. Subscriptions are available as monthly or annual plans.

4.3 Payment Processing

• All purchases are processed through Apple App Store or Google Play Store
• Pricing is displayed in the app and may vary by region
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage or cancel subscriptions through your App Store or Play Store account settings

4.4 Refunds

Refund requests are subject to Apple App Store and Google Play Store policies. We do not process refunds directly. To request a refund, please contact Apple or Google support.

5. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not attempt to reverse engineer, decompile, or disassemble the app
• Not use the Service to store illegal, harmful, or offensive content
• Not abuse or overload our servers or infrastructure
• Not attempt to gain unauthorized access to our systems

6. Intellectual Property

The Service and its original content, features, and functionality are owned by NilPointer Software and are protected by international copyright, trademark, and other intellectual property laws.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you agree to the collection and use of information as described in our Privacy Policy.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy of OCR scanning results
• Uninterrupted or error-free operation
• Fitness for a particular purpose
• Non-infringement

OCR Accuracy: While we strive for high accuracy in receipt scanning, we do not guarantee 100% accuracy. Users should verify scanned data before relying on it for financial decisions.

9. Limitation of Liability

To the maximum extent permitted by law, NilPointer Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or receipts
• Financial losses due to incorrect expense tracking
• Interruption of service
• Technical failures or data corruption

10. Service Modifications and Termination

We reserve the right to:

• Modify or discontinue the Service (or any part thereof) with or without notice
• Change subscription pricing with advance notice to existing subscribers
• Terminate or suspend access to the Service for violation of these Terms

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Kraków, Poland.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
